Litigation Attorney

Andrew D. Linden focuses his practice on litigating and resolving business disputes, representing clients in the alcoholic beverage industry, and providing general business law advice. Andrew handles complex commercial litigation matters such as shareholder disputes in closely-held companies, landlord/tenant actions, products liability and warranty claims, breach of contract actions, construction claims, and property tax appeals. Andrew counsels alcoholic beverage manufacturers, wholesalers, and retailers with all facets of their business. This includes licensing and regulatory compliance, business formation, and product labeling. He has assisted craft breweries and distilleries with applications before the New Jersey Division of Alcoholic Beverage Control and retailers with applications before the local municipality. Andrew provides guidance in connection with TTB federal permitting laws, and advises clients with respect to federal and state labeling requirements and approval processes. He also has experience helping clients navigate state distribution and beer franchise laws. Andrew contributes to the NMM Liquor Law Blog, which highlights legal and business issues affecting clients that make, sell or distribute beer, wine and spirits. Andrew has successfully represented business owners in shareholder disputes, including representing a physician against his former medical practice in a nine-day jury trial, resulting in a significant award in favor of the client. He regularly defends product liability, breach of warranty, and consumer fraud claims for various companies including window manufacturers. He also handles property tax appeals for the firm’s clients. Andrew also regularly handles construction litigations, such as prosecuting and defending construction defect lawsuits and construction lien claims, including representing contractors in connection with Metlife Stadium and the project formerly known as Xanadu. Andrew’s diverse experience allows him to identify and address legal issues for his clients in a variety of practice areas. Having litigated numerous commercial matters, he appreciates the need for proactive planning in an effort to minimize the chance of costly litigation, but is ready to actively pursue his client’s claims when necessary. Prior to joining NMM, Andrew served as a judicial clerk in the New Jersey Superior Court, Appellate Division, for the Hon. Harvey Weissbard (ret.) and the Hon. Rudy B. Coleman (ret.). While attending Seton Hall University School of Law, Andrew interned for the Hon. Dickinson R. Debevoise, U.S.S.D.J., was a senior editor of the Seton Hall Law Review, and was selected as a member of the Appellate Advocacy Moot Court Board. Andrew currently serves as a trustee of the Grover Cleveland Park Conservancy, which supports Essex County’s Grover Cleveland Park, and is an active member of the Lehigh Lawyers Association. He has previously served on the Executive Committee for Young Lawyers Division of the New Jersey State Bar Association. Every year since 2013, Andrew has been included in New Jersey Monthly’s Super Lawyers, Rising Stars, for Business Litigation.
