Experienced Commercial Litigation Attorney
Joseph J. Fleischman has substantial experience handling complex commercial litigation matters at both the trial and appellate levels. He has tried securities, antitrust, contract, corporate control cases, and a variety of intellectual property, patent, and unfair competition cases. In the area of securities, he has represented publicly-held companies, officers and directors, and broker-dealers in connection with 10b-5 actions, proxy fights, shareholder derivative suits, and tender offers. Joe has litigated various cases involving complex contract issues and partnership disputes. In the area of antitrust, he has defended clients against actions to prevent mergers and acquisitions and has represented clients in treble damage actions. He also advises clients about antitrust implications of business strategies with regard to pricing, distribution, and any other applicable factors. Joe’s practice includes representing financial advisors in FINRA and AAA arbitrations involving employment and customer disputes, FINRA investigations, disciplinary matters, as well as Forms U4 and U5 expungement and related employment matters. Prior to joining the firm, Joe was a partner at the law firm Hannoch Weisman, where he was one of the senior litigators in the areas of securities, contract, antitrust, franchise, and intellectual property law. He is a frequent contributor to legal journals and is the author of a number of articles on topics such as securities regulation, federal procedural issues, and legal malpractice. Joe has been selected for inclusion in The Best Lawyers in America in the Commercial Litigation section and New Jersey Super Lawyers in the Business Litigation section.
